01 · Agreement

Who provides the app and who these terms cover

MyBusinessDB is provided by FutureSpark Studio Ltd (“FutureSpark”, “we”, “us” or “our”). These Terms of Use apply when you download, access, purchase, or use MyBusinessDB.

By using the app, you agree to these terms and our Privacy Policy. If you use MyBusinessDB for an organisation, you confirm that you have authority to accept these terms for it. You must be at least 18, or otherwise legally able to enter this agreement. If you do not agree, do not use the app.

Your app store's terms and usage rules also apply. If a mandatory law or store rule conflicts with these terms, that mandatory requirement takes priority.

02 · Licence

Your permission to use MyBusinessDB

Subject to these terms and any applicable purchase, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable licence to install and use MyBusinessDB in object-code form on devices you own or control for your internal personal or business purposes. Store rules concerning family, organisation, or volume use continue to apply.

You do not acquire ownership of the app or its source code. Rights not expressly granted remain with FutureSpark and its licensors.

03 · Your information

Your records and responsibilities

You remain responsible for:

• entering only information and files you are entitled to use;
• handling customer, staff, and business information lawfully;
• keeping records accurate, complete, and appropriately retained;
• protecting your device and exported or backed-up files;
• checking every quote, invoice, expense, payment, report, tax treatment, total, and attachment before using or sharing it; and
• making sure MyBusinessDB is suitable for your organisation and working practices.

04 · Local-first operation

Local data, exports and backups

Device loss, damage, storage failure, operating-system action, app removal, or an unsuccessful update can make local data unavailable. Use the app's backup and export tools, keep separate copies where loss would affect your business, and test that important backups can be restored.

MyBusinessDB does not encrypt exported PDFs, CSV files, or backup files. Once you export or share a file, you are responsible for protecting it and for copies held by Files, cloud storage, email, or another service. Exported formats may not preserve every app feature or relationship.

05 · Paid access

Purchases, trials and subscriptions

Payments are processed by the Apple App Store or Google Play. Unless the purchase screen says otherwise, a subscription renews automatically for the displayed billing period until you cancel it through the store. Cancel before the next charge to prevent a further renewal. Cancellation normally takes effect at the end of the current paid period, subject to the store's rules and applicable law.

Refunds, billing disputes, payment methods, and restoration of store purchases are handled through the store, without reducing any rights you have under applicable law. A price or material subscription change will be communicated as required by the relevant store and law.

06 · Other services

Third-party services and terms

Your use of the Apple App Store, Google Play, device services, storage providers, email, spreadsheets, or any other service you choose is governed by that provider's terms. You must comply with applicable third-party terms when using the app.

FutureSpark does not control and is not responsible for the availability, security, content, retention, or separate actions of third-party services. A link or share option does not mean we endorse that provider.

07 · Product operation

Support, availability and updates

FutureSpark is responsible for MyBusinessDB support. Apple and Google have no obligation to provide maintenance or technical support for the app beyond their own store and account services. Contact us through the FutureSpark Support page.

We aim to provide a dependable app, but cannot promise that it will always be uninterrupted, error-free, compatible with every device, or available forever. We may release changes for security, compatibility, legal compliance, performance, or product improvement. Some updates may be required for continued use. Where practical, we will give reasonable notice of a material reduction or discontinuation.

08 · Ownership

FutureSpark intellectual property

MyBusinessDB, its software, design, branding, documentation, and original content are owned by FutureSpark or its licensors and are protected by intellectual-property laws. These terms do not transfer those rights to you. Feedback is voluntary; if you provide it, we may use it to improve our products without an obligation to compensate you.

09 · Fair and lawful use

Acceptable use

You must not:

• use MyBusinessDB unlawfully or to infringe another person's privacy or rights;
• upload or distribute malicious, deceptive, or unlawful material;
• interfere with the app, its security, or another user's lawful use;
• bypass purchase, entitlement, technical, or usage controls;
• copy, rent, lease, sell, redistribute, modify, reverse engineer, or attempt to obtain source code except where applicable law expressly permits it; or
• use or export the app in breach of sanctions, trade controls, or restrictions that apply to you.

10 · Check important decisions

Templates and business decisions

MyBusinessDB is an organisational tool. Templates, suggested fields, dates, costing, quotes, invoices, payments, expenses, categories, reports, and totals are not legal, tax, accounting, financial, medical, safety, or other professional advice. The app does not file VAT returns, statutory accounts, or tax returns for you.

Check outputs before relying on or sending them, and obtain qualified advice where appropriate. You are responsible for business decisions, filings, communications, and records made using the app.

11 · Legal protections

Warranties and consumer rights

We provide MyBusinessDB with the care and skill required by applicable law. Beyond rights and warranties that cannot lawfully be excluded, the app is provided “as available” and we do not promise that it will meet every particular requirement or produce error-free results.

12 · Responsibility for loss

Our liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your mandatory consumer rights, or anything else that the law does not allow us to limit.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable or for business losses where you use the app for commercial purposes.

If you use MyBusinessDB for business purposes, then to the maximum extent permitted by law: we are not liable for indirect or consequential loss, loss of profit, revenue, contracts, goodwill, anticipated savings, business opportunity, or data loss that reasonable backups could have prevented; and our total aggregate liability arising from the app in any 12-month period will not exceed the fees you paid for MyBusinessDB during that period.

We are not responsible for loss caused by inaccurate or unlawful information you enter, unreviewed outputs, failure to follow reasonable instructions or keep backups, device or third-party service failures outside our reasonable control, or a file transfer you chose to make.

13 · Apple users

Additional Apple App Store terms

This agreement is between you and FutureSpark, not Apple. FutureSpark, not Apple, is responsible for the app, support, product claims, and intellectual-property claims relating to MyBusinessDB. To the extent permitted by law, Apple has no other warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of the applicable app-licence terms and may enforce those terms against you.

If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price in accordance with its terms. You can read the Apple Standard EULA .

14 · Ending the agreement

Suspension, termination and local data

You may stop using MyBusinessDB at any time and cancel any subscription through the store. Uninstalling the app does not itself cancel a subscription. We may suspend or end the licence if you materially breach these terms, misuse the app, or if continued provision would be unlawful, subject to any rights that cannot be excluded.

When the licence ends, you must stop using the app. Because operational data is local, take any permitted export or backup you need before uninstalling or losing access. Provisions about ownership, responsibility, liability, and law continue where their nature requires it.

15 · Final provisions

Governing law and changes

These terms are governed by the laws of England and Wales. If you are a consumer, you retain any mandatory protections of the country where you live and may bring proceedings in the courts available to you under applicable law. Business users agree that the courts of England and Wales have exclusive jurisdiction.

If one provision is unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a reorganisation or transfer of the product, provided this does not reduce your mandatory rights.

We may update these terms for legal, security, store, or product changes. We will make the current version available here and, where required, give reasonable notice before a material change takes effect. Continued use after that date means the updated terms apply, except where the law requires fresh consent.
